Owning the Wind: The IP Controversy Surrounding Next Generation Wind Turbines Volume 1, Issue 2

Abstract:
On August 7, 2009, the U.S. International Trade Commission ruled that Mitsubishi wind turbines for sale in the United States infringed patent rights owned by GE and issued an exclusionary order preventing the importation of Mitsubishi products. This decision provides a framework for evaluating the current state of IP protection for wind power technology. Specifically, the concentration of wind power IP rights in a small number of dominant manufacturing firms hinders potential competition by small firms and developing countries. The concentration of IP rights also subjects the dominant wind turbine companies to antitrust litigation challenging their ability to engage in cartel like behavior with regard to controlling wind power technology.
